DUI Suspected in Modesto Auto Accident

According to the California Highway Patrol (CHP), DUI was suspected as a factor after an auto accident in the Modesto area on April 15, 2020. The car accident occurred around 5:15 p.m. on Inyo Avenue and Ustick Road. A driver of a Lincoln SUV was reportedly speeding on Inyo Ave. The Lincoln driver allegedly ran the stop sign at the intersection and crashed into another driver, causing the Lincoln to overturn into the front yard of a home. The CHP said the Lincoln driver was transported to a local hospital for treatment of minor injuries and later arrested for felony driving under the influence. The other motorist also suffered minor injuries. However, it is unknown whether the other party was hospitalized following the crash.

What is Included in a Bodily Injury Claim for a Drunk Driving Accident?

When a person is injured in a car accident caused by a drunk driver, that party may be able to recover compensation for their losses through a personal injury claim. To recover compensation for such cases, substantial evidence must be collected to prove negligence on the part of the other driver. Negligence is considered failing to exercise reasonable care to others. In the context of a car wreck, the injured party must prove that the other driver owed them a duty of care, the negligent driver breached their duty of care by driving under the influence, and their behavior was a direct cause of the crash and resulting losses. This can be done by compiling evidence such as police reports, traffic violations, video surveillance in the area, and photographs of the accident scene and property damage. Pursuing Compensation After a DUI Auto Accident in Modesto

People injured in drunk driving accidents may be able to recover economic and noneconomic damages from the negligent driver and their insurance company. This may include medical expenses, lost earnings, loss of consortium, permanent scarring or disfigurement, and pain and suffering. Punitive damages may also be awarded by a jury or a judge for particularly egregious behavior, like driving under the influence. An exact calculation of damages will be dependent upon the severity of the accident, injuries, and losses incurred.

What is the Statute of Limitations on a Car Accident Claim?

A personal injury lawsuit must be filed within a specific time frame, known as the statute of limitations. In California, the statutory deadline is two years from the date of a car accident. If a claim is not filed in civil court by the required time limit, the injured party may lose the right to recover compensation. Thus, it is essential to work with a Modesto personal injury lawyer who can determine what criteria and deadlines apply to your personal injury case.
