Pedestrian Injury Accident Leads to Driver’s Arrest

A driver was placed under arrest by authorities after causing a pedestrian injury accident in Sacramento recently. The driver in question is suspected of drunk driving and was accompanied by his toddler at the time the collision occurred. The California Highway Patrol (CHP) report said the accident happened at about 10:35 p.m. on the exit for Marconi Avenue near eastbound I-80.

Details of the Pedestrian Injury Accident

The police report said the 34-year-old driver was in a Lexus and accompanied by his son, who is a toddler when he hit a Toyota Camry and Ford and afterward struck a 62-year-old pedestrian. The pedestrian suffered major injuries in the accident, including a broken back. The Lexus driver then fled from the accident scene. He was located later at his home and was placed under arrest for felony hit-and-run, child endangerment, and suspicion of DUI. The driver is now out on bail.

Filing a Personal Injury Claim

A pedestrian who has been injured by a negligent driver may be able to file a claim to recover damages from the at-fault motorist. We believe that no one should be responsible for the financial losses caused by a negligent driver. My team of injury attorneys and I have successfully handled many cases of this type and may be able to do the same for you. Some of the compensation that can be recovered includes:

  • All medical expenses can be recovered, which include ambulance fees, hospitalization, surgeries, prescriptions, tests, and rehabilitation. If the injury is expected to continue into the future, those costs are factored into the settlement.
  • Lost wages, including expected bonuses and other job perks, are recoverable. If the injured pedestrian has to take a demotion because they can no longer perform their job, that is factored in also. If they become permanently disabled and can no longer work, the amount they would have earned until retirement age is included.
  • Loss of household services can be recovered. These are areas where the person performed work at home before the pedestrian injury accident. That might include mowing the lawn, childcare, and others.
  • Loss of the enjoyment of life covers activities the injured party enjoyed and can no longer do, such as skiing, hiking, and participating in sports.
  • Loss of consortium and the affection of a spouse is recoverable.
  • Loss of guidance, nurturing and parental care can be claimed.
  • A monetary value can be placed on the individual’s pain and suffering, including those that are physical, emotional, and psychological. For example, if an injured party has nightmares, anxiety, panic attacks and other symptoms that force them to seek professional help to treat, the cost of treatment can be recovered.
  • Punitive damages: Punitive damages are rarely awarded but are available to those whose injuries were intentional or the pedestrian injury accident was egregious. Drunk driving may qualify as egregious in these instances.
