Woman Killed After Fatal Car Accident Northeast of Dos Palos

Dos Palos Woman Killed After Fatal Collision

A woman was killed after a fatal traffic collision just northeast of the Dos Palos area on the night of Tuesday, September 29, 2020. According to the California Highway Patrol (CHP), the car accident occurred shortly before 9:00 p.m. at Palm Avenue and Carmellia Avenue in Merced County. A 37-year-old woman was driving a 2005 Chrysler eastbound on Carmellia Avenue before coming to a stop in the eastbound lane to make a left turn. A driver of a 1998 Jeep was traveling behind the Chrysler and attempted to overtake the vehicle by entering the oncoming traffic lane. While doing so, the Chrysler allegedly turned left in front of the Jeep, and the left side of the Chrysler was struck by the front of the Jeep.

The impact of the collision propelled the Chrysler into a parked 2013 Chevrolet Camaro. This caused the Camaro to be pushed into a 2001 28-foot long-trailer. The Chrysler came to a rest after colliding with a tree, which resulted in the driver suffering fatal injuries. The cause of the fatal crash is under investigation by the CHP, and no further details, including the name of the decedent, have yet been released.

What is Wrongful Death?

Wrongful death is stated to have occurred when negligence or carelessness results in loss of life. A wrongful death claim can be brought by the family of the person who was killed in a motor vehicle accident due to someone else’s negligent or reckless actions. In such situations, survivors can file a lawsuit against the insurance company representing the at-fault party to seek financial compensation. A wrongful death case is a civil action that is designed to make the surviving family members whole after the loss of a loved one in terms of financial and emotional support.

Wrongful Death Damages That Can Be Recovered After a Fatal Dos Palos Collision

Specific surviving family members may be entitled to monetary damages through a wrongful death claim. In situations involving fatal car accidents, these cases are generally filed with the insurance company representing the at-fault party to recover non-economic and economic losses. These may include lost future financial support, mental anguish, funeral expenses, loss of companionship, end of life medical costs, and more. For more details on these cases, watch the video below.

What is the Filing Deadline for a Wrongful Death Claim?

The time to bring a wrongful death claim is limited due to the statute of limitations. Under the California Code of Civil Procedure Section 335.1, survivors only have two years from the incident date to file a wrongful death lawsuit if a fair settlement is not accepted by the insurance company within that deadline.
