Lawsuit Filed in Deadly Folsom Stairway Collapse

The family members of 26-year-old Shun Xiang Yuan who died in a tragic staircase collapse on July 3, 2015, have filed a lawsuit claiming negligent death.  The man was visiting his friend who resided at the Legends at Willow Creek Apartments in Folsom.  As he ascended the concrete staircase to the third floor, the stairs collapsed and he fell two and one-half stories to the ground.  The staircase fell on top of him.  The man was fatally injured as a result of this tragedy.

Details of the Deadly Folsom Stairway Collapse Lawsuit

The wrongful death complaint alleges that the owner of the complex and their development partners knew it was likely that injury or death could occur to people accessing that particular staircase.

Dry Rot Issue

The lawsuit claims the defendants knew about a dry rot issue on the premises after a prior stair collapse back in 2014 but failed to make necessary repairs. Additionally, the plaintiff’s claim the companies recklessly disregarded unsafe conditions and have failed to comply with building codes.

What is a Premises Liability?

When a tragedy like the deadly Folsom stairway collapse occurs to a guest or tenant living on another person’s real property, the actual owner of that property may be found liable (legally responsible) if you can successfully prove that the owner’s negligence led to the death or injury of the victim.  Having an experienced premises liability attorney on your side is imperative if you are making a claim for negligence on the part of the property owner.
