Losing Someone You Love After an Accident

After the loss of a loved one, surviving family members may experience a range of emotions. In addition to emotional hardship, unexpected death may also leave the family with financial burdens. When the loss was the result of someone else’s negligence, it may be considered wrongful death under California law, and survivors may seek justice and compensation. An experienced wrongful death lawyer in Fresno can work to help a family who has lost a loved one in a fatal car accident by protecting their best interests and rights to financial compensation.

What is a Wrongful Death Claim and How it Can Help My Family?

California law allows specific family members to recover economic and noneconomic damages related to the wrongful death of a close relative. Such damages serve to make a family whole again after a loved one’s wrongful death. The types of financial compensation that may be sought through a wrongful death case include:

  • Costs of funeral and burial services for the deceased;
  • Expenses for end of life medical treatment incurred by the loved one;
  • Loss of earnings, future financial support, and benefits that surviving family members would have received from the decedent if they survived;
  • Lost care, companionship, guidance, and moral support; and
  • Punitive damages may be awarded when a loved one’s wrongful death was due to egregious conduct on behalf of the at-fault party.
