Losing a Family Member to a Wrongful Death Bicycle Accident in Clovis

It is challenging to come to terms with the thought that a member of the community may have disregarded the life, health, and safety of a loved one. Sadly, negligence can cost a close relative’s life. Few words can bring true comfort to a family when recovering and grieving from such a loss. When this happens, the at-fault party may be held financially accountable for causing the loss through a wrongful death claim. By taking legal action, a family can start to make empowered choices toward the recovery and closure they deserve.

What Losses Can Be Recovered in a Wrongful Death Case?

A wrongful death claim is a civil action that allows specific family members of a person who was killed due to negligence to recover economic and non-economic damages. Relatives who may be compensated for a loved one’s wrongful death in California are called survivors, those who are entitled to the recovery of:

  • Costs associated with a loved one’s final resting expenses
  • Expenses for medical treatment received by the loved one after the fatal accident before they passed away (this can be recovered through a survival action filed by a Fresno wrongful death attorney on behalf of your family)
  • Loss of services and future financial support from the decedent
  • Loss of a family member’s care, protection, and companionship

Which Family Members Can File a Wrongful Death Claim in California?

If you have lost a family member to a fatal motor vehicle accident, you may be wondering if you have the legal right to take action against the negligent driver. According to the California Code of Civil Procedure Section 377.60, the following survivors are entitled to damages through a wrongful death lawsuit:

  • The surviving spouse, domestic partner, or children of the deceased person have priority
  • If such parties are nonexistent, then the surviving parents, putative spouse, children of the putative spouse, or stepchildren are next-in-line
