What to Expect from the Auto Accident Claims Process

When you have suffered injuries in a car accident, you may be entitled to the financial recovery of medical expenses, lost wages, and more. However, the process of seeking compensation for accident-related losses is not always straightforward, and that may be apparent once the claims process is started. It may be overwhelming to deal with claims adjusters, especially when they are undervaluing bodily injury claims, disputing liability for the crash, or using other defense tactics as a way of paying as little as possible.

As with other types of motor vehicle collisions, determining who was at fault in a car accident is a matter of collecting evidence that is suggestive of which party was negligent. Establishing fault is the most crucial element of any personal injury case. In California, injured parties may bring a claim against the at-fault party and their insurance company for damages incurred. However, it is not uncommon for negligent parties and their insurers to dispute fault as a way of minimizing their financial liability for the incident. After all, California follows a system of comparative fault, meaning that the amount of financial recovery awarded in court may be decreased by the percentage of negligence assigned to the injured party.

Retaining legal counsel after you have suffered traumatic injuries in a motor vehicle collision is always an option, particularly when liability is being disputed. If the incident was the result of someone else’s negligence, you may have the right to recover financial compensation for your damages, and an experienced accident attorney can help make that happen. An injury lawyer can help protect your interests, guide you through the process, deal with difficult insurance companies, collect evidence that is suggestive of the other party’s negligence, and build a strong case for fair compensation. However, finding the best lawyer in your area may be challenging. To learn how to determine whether an attorney is a good fit for you and your case, watch this video.
