As of this report, additional details regarding the pedestrian’s condition and the circumstances of the accident have not been released. The CHP traffic accident unit is actively investigating the cause of the crash.

Driver Negligence and Pedestrian Injuries

Driver negligence is a leading cause of pedestrian accidents, often resulting in serious harm to walkers. When a collision occurs, the injured party has legal rights to seek compensation, and an experienced accident lawyer can play a key role in the recovery process.

Common Driver Causes of Pedestrian Accidents

Many pedestrian collisions are directly linked to careless driving behaviors. Distracted driving is a top factor, such as motorists checking phones, adjusting in-car devices, or simply failing to stay alert, may not notice a pedestrian in time. Speeding significantly reduces reaction time; at higher speeds, both the frequency and severity of these accidents rise.

Failure to yield at crosswalks, whether from impatience or lack of awareness, is another frequent cause of a Castro Valley pedestrian accident, as those on foot often have the legal right-of-way, especially at intersections or marked crosswalks. Impaired driving, whether due to alcohol, drugs, or even fatigue, can cloud judgment and slow response times, making streets far more dangerous for those on foot. Poor weather, low visibility, and complex multilane roads can further increase risk, but a large portion of blame remains with driver attentiveness and compliance.

The Seriousness of Pedestrian Injuries

Pedestrians are vulnerable in a collision due to the lack of protection compared to occupants in vehicles. The majority of injuries involve the lower extremities, but head trauma is common and especially dangerous, often resulting in long-term consequences or fatality. Speed and impact force play a major role: Higher vehicle speeds not only increase the chance of an accident but also escalate injury severity. Many walkers suffer from broken bones, spinal cord injuries, traumatic brain injury, or internal damage, posing extended recovery times and mounting medical bills. The emotional and financial toll can be devastating for those who suffer trauma and their families.

How an Accident Lawyer Helps You Recover

Navigating a pedestrian accident claim requires legal expertise, particularly when fault is contested or insurance companies dispute the seriousness of injuries. An experienced accident lawyer can gather crucial evidence, consult with medical experts, and negotiate effectively with insurers to ensure injured pedestrians receive the compensation they deserve for medical costs, lost income, pain and suffering, and future treatment needs. Lawyers also ensure their clients’ rights are protected and guide them through every step of the legal process, from initial filing to, if needed, trial.

As personal injury lawyer Ed Smith notes, an attorney should demonstrate several key qualities essential to effective legal representation:
