Motorist Driving on Madison Avenue Causes Pedestrian Injury Crash

A serious pedestrian injury crash occurred in Carmichael on November 3 in a collision involving a motor vehicle. The accident occurred along Madison Avenue near Manzanita Avenue in the right-hand lane during the evening hours. Officials with the California Highway Patrol (CHP) stated that the car was going west along Madison Avenue when the pedestrian was struck.

Driver Involved in Pedestrian Injury Crash Remains at Scene

The driver allegedly spotted the pedestrian and tried to stop, but it was too late. The motorist remained at the accident scene. Alcohol or drug use was not a factor in the crash. The unidentified pedestrian was transported to a hospital suffering from major injuries. The accident is under investigation by CHP traffic collision detectives.

Injury Lawyers Can Help With Pedestrian Accidents

Pedestrians must prove that motorists or other entities acted negligently to recover compensation after an accident. A lawyer can investigate your situation to determine if you have a claim. An investigator will then gather evidence to help the client pursue the compensation they deserve.

Evidence Gathering in a Carmichael Pedestrian Injury Crash

Investigators use a number of evidence-gathering techniques for personal injury lawyers. These techniques include performing accident reconstruction, checking cameras nearby for video footage of the collision, interviewing witnesses, and examining the police report for accuracy. Once the evidence has been collected, it is given to our attorneys.

Our attorneys use the evidence to build a strong case for our clients. It can also be used to aid in negotiations with the at-fault driver’s insurance company. If the insurance company fails to provide adequate compensation, a case may be filed in civil court to recover damages.

Staying Within the Statute of Limitations

The statute of limitations to place a personal injury claim in California is two years. This means that if the injured party places a claim later than two years from the date the accident injury occurred, the court will refuse to hear it. Additionally, witnesses can disappear as well as evidence if the injured party waits too long. Contacting an injury lawyer as soon as possible following your accident gives them a better opportunity to collect the evidence that supports your claim.

Damages That Can Be Recovered

Injury claims in pedestrian accidents include the costs of all medical care resulting from the accident. A person may also claim lost wages if they are unable to work, forced to take a lower-paying job or become disabled. An injury lawyer can help you recover compensation for pain and suffering, including both physical and emotional trauma.
