Details on the SR-108 Accident and the Biker Airlifted to a Modesto Hospital

An air ambulance was requested at the crash site. One patient was transported via air ambulance to a Modesto area hospital for treatment of injuries described as minor. Further details on the collision, including what caused it, were not immediately disclosed by CHP traffic officers.

Protecting Your Rights After an Accident as a Motorcyclist

A common misconception about motorcycle crashes is that they are often the result of the biker’s actions. However, that is not always the case. Most motorcyclists are safe and responsible riders that follow the rules of the road and take every step to protect themselves from harm’s way. More often than not, negligent drivers and entities are to blame for such situations. Some of the parties that may be found at fault for a solo motorcycle crash include:

  • Driver Negligence: Most motorcycle crashes are often the result of driver negligence, including sudden lane changes without checking riders in blind spots, switching lanes without using signals, speeding, and more. It is possible for a solo motorcycle accident to be the result of a phantom vehicle or a hit-and-run. Cases involving phantom vehicles and hit-and-run drivers are much more challenging to establish and require the expertise of a skilled attorney.
  • Faulty Motorcycle: In some cases, crashes are not the result of driver negligence. Mechanical defects in motorcycles may increase the chances of a crash. Faulty bike parts and equipment may include seats, pedals, handlebars, steering mechanisms, tires, wheels, and braking systems. Manufacturers responsible for placing such defective products on the market may be held financially accountable for damages incurred through an auto products liability claim. Keep in mind that the damaged motorcycle must be kept and preserved until an experienced attorney and their team of experts has evaluated it for potential defects.
  • Road Defects: The size and maneuverability of motorcycles may make them more susceptible to traffic collisions. Common types of accidents involving motorcyclists are those occurring when a biker strikes uneven pavement or a pothole. When this happens, and a motorcycle rider suffers injuries as a result, they may bring a claim against the government entity responsible for the design and upkeep of the road for damages incurred. Such cases are subject to a shorter statute of limitations, as outlined in the California Government Code Section 911.2. Therefore, it is essential for an injured biker to act quickly and retain legal counsel when bringing a government entity claim for a road defect.

What motorcycle riders should know is that injury lawyers are committed to helping bikers like them who have suffered harm because of the negligent actions of others. For details on what to look for in the best motorcycle accident lawyer, watch this video.

Contacting an Attorney After an Accident

To seek full and fair compensation after a wreck, a motorcycle accident injury lawyer must demonstrate that the traumatic injuries and damages suffered were the result of the other party’s negligent actions. In brief, negligence is the failure to provide a duty of care that is expected in particular situations. To establish this, an attorney must ensure that various elements of negligence are proven in the case.

Navigating California’s laws and the personal injury claims process after a motorcycle accident may be challenging to handle alone. The insurance company representing the other party or your own may be unfair when it comes to making a settlement offer. Fortunately, our attorneys are here to help you seek fair compensation for your injuries and resulting losses. Contact us today to learn more about how our legal team can help you.
