Seeking Justice and Financial Recovery in a Wrongful Death Bicycle Accident Case

For surviving family members, taking legal action may be the least of their concerns after the loss of a loved one in a bicycle accident. However, it is essential to hold the at-fault party accountable for their actions. Eligible claimants may seek non-economic and economic damages from the negligent party, including funeral costs, loss of earnings, loss of companionship, mental anguish, and more. Punitive damages may be recovered in a fatal bicycle accident case in which the at-fault party acted in particularly egregious conduct that led to the cyclist’s demise.

Under California law, surviving family members must file a lawsuit within two years of the date of loss. Failure to protect the statute, as outlined in CCP 335.1, may lead to the court dismissing the matter. This may further result in the loss of the right to seek damages in the case. Moreover, the claim must be settled within that deadline, or the matter must be filed in civil court to protect the statute. Insurance carriers often resort to defense tactics, such as delaying claims, in hopes of the claimant missing the time limit to file the case.

A case of wrongful death may be challenging, particularly when multiple parties are involved. Due to the amount of time and effort that is required to build a compelling wrongful death claim, it is essential to retain legal counsel right away. Having an experienced California wrongful death attorney on your side can allow you the time to focus on grieving and recovering. Your lawyer will conduct an in-depth investigation, handle communication with insurers, and build the strongest case possible to secure a full financial recovery on your family’s behalf.
