What Kind of Damages Are Recoverable?

When injured through someone else’s negligence, the victim of a crash may face mounting medical bills, lost time from work and other expenses. Our team of investigators is experienced at proving fault, so an accident victim can obtain the damages they deserve.

Any medical expenses associated with an accident are recoverable. These include ambulance fees, doctors’ bills, including specialists, prescriptions, physical and cognitive therapy and home services.  Transportation for treatment or appointments and medical accessories such as a wheelchair, walker or others is also included. If continued care beyond the settlement date is needed, future expenses are calculated into the figure.

Lost wages are included in the damages, including loss of earning capacity if the individual is no longer able to perform the same type of job. Damages based on diminished earning capacity are usually based on the age of the person, skill and education levels, occupation and life expectancy. Loss of companionship or loss of affection refers to a couple’s inability to engage in the benefits of marriage following an accident. Pain and suffering is determined by the duration and severity of pain.
