Fatal Paradise Highway Crash

Fatal Paradise Highway Crash

I’m Ed Smith, a Paradise personal injury lawyer. A man from the nearby city of Magalia tragically lost his life because of injuries he suffered during a recent area car accident. The accident happened on Monday, May 21, 2018, during the afternoon. California Highway Patrol (CHP) officers who responded to the incident said that only one vehicle was involved and that they are trying to find out what caused the crash to occur. Butte County Sheriff’s Office officials released the identity of the man soon after the accident, identifying him as 70-year-old Kevin Macphail. My support and sympathy are sent to Macphail’s friends and members of his family while they mourn their lost loved one.

Crash Details

Officers of CHP reported that the crash happened on Skyway close to Canyon Rim Place near Paradise. At about 2:50 p.m., Macphail had been driving a 2005 Chevrolet Avalanche heading west in the number two lane when he suddenly veered to the right. The movement caused the Avalanche to travel slightly off the highway. CHP stated that Macphail seems to have tried to correct his vehicle, but pulled too sharply to the left. Macphail’s car crossed over both westbound lanes into the highway median, where he crashed into a large boulder.

Response

When responders arrived at the crash location, they found Macphail in his vehicle with serious injuries. Medics gave Macphail emergency care and had him put inside an ambulance that took him to the Enloe Medical Center in Chico. Despite the efforts of hospital staff, Macphail sadly lost his life shortly after arrival.

Causal Factors

Officials have noted that they do not suspect intoxication by alcohol or drugs to have been involved in this collision. Investigating authorities say they do not know why the Avalanche veered off of the road in the first place. Additionally, CHP has not reported whether Macphail seemed to have been driving normally before the crash.

Auto Products Liability

In many crashes, it is obvious that an accident was caused by a negligent driver. When this happens, the reckless motorist can be held responsible for paying for damages. However, collisions can be caused by a car part that isn’t working correctly. In these cases, the at-fault party is not another driver, but the seller, manufacturer, or retailer of the malfunctioning part. These are called “auto products liability” cases.

As with accidents involving a reckless driver, at-fault parties can be held responsible for auto products liability cases. In the event of a wrongful death, those responsible for the faulty product can often be liable to pay for a variety of losses.
