Fatal Rollover Crash Occurs on Mountain View Road

An Elk Grove driver on his way to help clean up storm damage died on January 7 after a rollover crash. The man, identified as 37-year-old Edgar Castillo, was traveling west along Mountain View Road, near Rancheria Road, with another male, 24-year-old Jose A. Hernandez, a Camino resident. The accident occurred before 7:30 a.m. as the truck neared Manchester, west of Ukiah, in a Freightliner boom truck.

Rollover Crash Occurs After Boom Truck Hits Guardrail

According to the Ukiah Area Office of the California Highway Patrol (CHP), the driver missed a turn, causing the truck to hit a guardrail, resulting in it overturning and rolling down the dirt embankment. Castillo died at the accident scene. Hernandez, the passenger, was transported to a hospital with major injuries.

Storm Damage Cleanup Is a Dangerous Job

The CHP is investigating the cause of the fatal rollover crash and do not believe that drugs or alcohol factored into the cause. The family of Edgar Castillo has set up a GoFundMe site. They reported that Castillo, a PG&E subcontractor, often worked in difficult locations and harsh weather conditions, clearing roads in Northern California that had been impacted by wildfires and severe weather.

Investigation Ongoing to Determine Cause of Accident

At the time the accident occurred, Castillo and Hernandez were working for a company that had been contracted by PG&E, Mountain F Enterprises, to perform work relating to vegetation management. The CHP is determining the cause of the accident.

Roadway Negligence as a Cause of a Vehicle Accident

Driver error is not the only cause of accidents where vehicles exit the road. There are other reasons as well. The inability of a vehicle to navigate difficult turns or curves safely can be caused by poor road design or defects in the roadway, including missing or defective guardrails, and lead to a rollover crash. It is possible to file a claim against a government agency responsible for the road’s design or maintenance if it results in an off-road accident.

Damages Recovered in a Personal Injury or Wrongful Death Claim

If you want to file a personal injury or wrongful death claim against a government entity, you have only six months, so it might be best to seek legal advice right away. Once that six-month period passes, the court will no longer hear the case. Personal injury claims allow individuals to seek financial compensation for a variety of damages, including lost wages, medical expenses and pain and suffering. In filing a wrongful death claim, the family may recover the funeral and burial expenses, wages until retirement age along with insurance and pension benefits and pain and suffering.

Your lawyer will help determine who is at fault and liable for your injuries or the death of your loved one. This can include the person responsible, their employer, a manufacturer of defective products or the government. Your lawyer will also examine all evidence related to the case, such as police reports and traffic surveillance cameras.
