Understanding Fremont Hit-and-Run Accidents

A hit-and-run accident can leave people shocked, injured, and uncertain about what to do next. These types of crashes occur when a driver causes a collision and leaves the scene without stopping to exchange information or render aid. Beyond being illegal, fleeing an accident scene can have devastating consequences for the injured party, who is left to deal with physical, emotional, and financial hardship.

Why Drivers Flee the Scene

Drivers flee accident scenes for a variety of reasons, often rooted in fear, negligence, or recklessness. Common motivations include:

  • Driving under the influence of alcohol or drugs
  • Lacking a valid driver’s license or insurance
  • Fearing arrest due to outstanding warrants or prior offenses
  • Panic and poor judgment following the crash

Regardless of their reasons, fleeing drivers violate California Vehicle Code §20001, which requires all motorists involved in an injury collision to remain at the scene and provide assistance.

How an Attorney Investigates a Hit-and-Run

A knowledgeable accident lawyer plays a key role in helping those injured in a Fremont hit-and-run by thoroughly investigating the crash. Attorneys often work with private investigators and reconstruction experts to locate the responsible driver. Investigative steps may include:

  • Obtaining and reviewing traffic surveillance or business security footage
  • Collecting eyewitness statements and social media tips
  • Working with police and insurance adjusters to track partial license plate numbers or vehicle descriptions
  • Analyzing vehicle debris, paint transfer, or damage patterns to identify the fleeing car

Even when the at-fault driver cannot be located immediately, a persistent and skilled legal team continues to pursue every lead.

Compensation Available to Those Injured in a Hit-and-Run

Individuals injured in a hit-and-run crash may be entitled to recover several forms of compensation, including:

  • Medical expenses, both current and future care
  • Lost wages and reduced earning capacity
  • Physical pain, emotional trauma, and loss of enjoyment of life

If the responsible driver is identified and insured, compensation typically comes from their liability coverage. When the driver remains unidentified or uninsured, victims can turn to their own uninsured/underinsured motorist (UM/UIM) policy. This coverage helps pay medical bills, lost income, and other damages as if the fleeing driver had been insured. Filing a UM/UIM claim can be complex, but an experienced lawyer ensures that injured people maximize their available benefits.
