Loss of a Loved One

The loss of a loved one after a car accident can devastate a family. The emotional trauma related to this type of unexpected loss is difficult to come to terms with. Many surviving family members often do not fully recover psychologically or emotionally from losing someone they love. A Stockton wrongful death lawyer can put a jury in their shoes to ensure they understand the immense pain and sorrow survivors experience when they lose a close relative in an accident due to the negligence of someone else.

What Type of Damages is Available in a Wrongful Death Claim?

Compensation in a wrongful death claim generally includes economic and non-economic damages. Economic damages may include costs of end of life medical care, funeral and burial expenses, and future financial support of the decedent. Noneconomic damages include emotional trauma and mental anguish related to unexpected loss. It is the emotional devastation families experience after the life of a loved one is claimed in a preventable accident. Punitive damages may be sought from the at-fault party under specific circumstances. These damages are not paid by the negligent driver’s insurance company. Instead, they are recovered from the wrongdoer directly as a way of punishing them for their egregious behavior, like excessive speeding or driving under the influence in a wrongful death car accident. How Long Does a Family Have to File a Wrongful Death Lawsuit?

Wrongful death claims in California are subject to a filing deadline known as the statute of limitations. This is a specified period in which a wrongful death lawsuit must be filed if a settlement is not reached with the insurance company within California’s two-year statute of limitations. Time is of the essence for surviving family members who are eligible to seek compensation from negligent parties and hold them accountable for their actions resulting in the loss of their loved one. If a case is not brought within the deadline, the claim may be dismissed and not heard by the courts.
