Accidents in Construction Areas

A two-vehicle accident in a construction area can be the fault of one of the drivers. It may also happen because of negligence in the construction zone or by the company doing the work. Driver liability may be due to the following:

  • The driver is following too closely and doesn’t stop in time to avoid a rear-end collision with the vehicle in front.
  • A vehicle strikes a piece of equipment or sign, resulting in a chain-reaction involving other vehicles.
  • The driver is speeding and unable to slow down in time to avoid a two-vehicle accident.
  • The driver was talking on a cell phone or texting and did not realize they were approaching a construction zone.

Fault on the Part of a Construction Company

Construction companies performing roadwork are required to make the area safe for motorists who are passing through. Failure to do so makes the company liable for injuries in an accident. The following are examples of how a company can be negligent:

  • Poor or unclear design of a route through a construction zone can lead to a two-vehicle accident.
  • Detour signs are unclear or not visible.
  • Barricades, signs, or equipment are placed too close to passing vehicles.
  • Construction equipment is in the way of vehicles that have to pass through.
  • Poor maintenance along the route makes it dangerous for passing motorists.

Investigating a Two-Vehicle Accident

The investigation of a two-vehicle accident takes into account its location and other important factors. Because the evidence in the case must be gathered for a client to collect the personal injury damages they deserve, an experienced lawyer can help. Following are some of the areas in which the investigators collect that evidence:

  • The investigators check the report by the police for errors and interview the witnesses to the two-vehicle accident.
  • They perform forensic reconstruction, which can determine how the two-vehicle accident occurred and point out driving errors.
  • Surveillance cameras in the area are sought because they may have taped the accident as it happened.
  • Negligence in road maintenance is sought, which might include defective guardrails, poorly marked lines, or bad lighting. The government entity charged with maintenance may be held liable if any of these factors contributed to the crash.

Our experienced lawyers use this gathered evidence to construct a strong case that favors our client’s compensation claim. It is used either in court or during insurance company negotiations to obtain the best outcome for our client.
