A 69-year-old Patterson man was driving a Ford pickup truck eastbound on East Main Street. At the same time, a Turlock woman was headed westbound in a Nissan sedan. For unknown reasons, one of the vehicles entered the oncoming traffic lanes and collided head-on with the other.

How a Wrongful Death Claim Works for Surviving Family Members

A motor vehicle collision may often result in traumatic and lasting consequences. What is most unfortunate is that in some extreme cases, the incident may result in the loss of a close relative. In such situations, survivors may file a wrongful death claim against the driver responsible for the fatal car accident. This type of claim will seek to provide the family with compensation for economic and non-economic damages. However, specific surviving family members have priority when it comes to bringing these types of cases forward. Under the California Code of Civil Procedure Section 377.60, the surviving spouse, domestic partner, or children of the decedent may recover damages. If such immediate family members are nonexistent, other relatives may file under specific circumstances.

California law is specific about the amount of time within which survivors must file a wrongful death lawsuit if the case is not settled with the insurance company. There is a two-year statute of limitations that apply to these cases under the California Code of Civil Procedure Section 335.1. It is essential to keep in mind that other filing criteria and deadlines must also be met.
