Train Kills Pedestrian
I’m Ed Smith, a personal injury attorney in Modesto. An Amtrak train struck a 27-year-old man in the vicinity of Hughson on the afternoon of Wednesday, October 19, 2016. Unfortunately, the man passed away due to the severe nature of his injuries.
The man was crossing the Burlington Northern Sante Fe (BNSF) tracks along Sante Fe Avenue at 2:05 pm when an Amtrak train was traveling north on the tracks at about 80 miles per hour. The man was struck by the train which tragically propelled his body about 100 feet from the tracks. The train remained stopped at a short distance north at the intersection of Seventh Street.
What Went Wrong?
The conductor of the Amtrak train informed the deputies from the Stanislaus County Sheriff’s Department that he observed the man attempting to cross from the east side of the train tracks to the west side. The conductor stated he was unsure whether the man intentionally crossed the tracks or miscalculated the speed of the approaching train.
We extend our condolences to the friends and loved ones of the man who passed away so tragically.
The United States Department of Transportation has increased federal funding to bring awareness and promote law enforcement efforts regarding the safety of railroad crossings. One of the most common train accidents involve motor vehicles. Some vehicles may become stuck at the crossings due to driver confusion or faulty signals and gates. More causes that contribute to train collisions at train crossings are the failure of the breaks on the trains and the trains traveling at excessive speeds. Additionally, defects in the railroad crossings can sometimes fail to alert drivers and pedestrians in a timely manner that a train is approaching. These types of accidents can result in traumatic injuries and oftentimes fatalities. It is best to consult with an experienced train accident attorney to protect your rights after a railroad crossing accident.
