I’m Ed Smith, a personal injury attorney in Modesto. An Amtrak train struck a 27-year-old man in the vicinity of Hughson on the afternoon of Wednesday, October 19, 2016. Unfortunately, the man passed away due to the severe nature of his injuries.

What Happened?

The man was crossing the Burlington Northern Sante Fe (BNSF) tracks along Sante Fe Avenue at 2:05 pm when an Amtrak train was traveling north on the tracks at about 80 miles per hour. The man was struck by the train which tragically propelled his body about 100 feet from the tracks. The train remained stopped at a short distance north at the intersection of Seventh Street.

What Went Wrong?

The conductor of the Amtrak train informed the deputies from the Stanislaus County Sheriff’s Department that he observed the man attempting to cross from the east side of the train tracks to the west side. The conductor stated he was unsure whether the man intentionally crossed the tracks or miscalculated the speed of the approaching train.
