Obtaining Justice and Compensation in a Wrongful Death Car Accident Case

Losing a family member in an auto wreck may cause an emotional and financial toll on surviving family members. This is particularly true if someone else is responsible for the loss of life. When a family loses a loved one in a motor vehicle collision caused by a negligent driver, they may have grounds for a wrongful death action against the at-fault party. This serves to make survivors whole again through financial compensation. If the negligent motorist does not carry liability coverage or has minimal limits, a family may turn to the deceased’s uninsured and underinsured motorist protection for financial recovery.

Eligible survivors may be compensated for non-economic and economic damages in a wrongful death action. These include reasonably expected financial support, loss of companionship, mental anguish, funeral service costs, medical expenses (via survival actions), and other related losses. If there is clear evidence demonstrating that the individual or entity who caused the fatal incident acted egregiously, surviving family members may be entitled to punitive damages. These are solely intended to punish the other side for their egregious actions.

Coping with grief and loss is challenging enough, and the least of a family’s concerns is taking legal action. However, it is crucial to hold the other side liable for the harm they have caused. If you have lost a family member due to a car crash, you and your family may have many questions on how to hold the at-fault party accountable and how to move forward in your situation.
