South Sacramento Fatality Closes Elder Creek Road

A South Sacramento fatality occurred during the early morning hours of January 4, when two vehicles collided along Elder Creek Road. The accident happened shortly after 7:00 in the morning. However, few details have been released. According to authorities with the Sacramento Police Department, the major collision caused the closure of Elder Creek Road between Sun River Drive and Logan Street. Drivers were urged to use an alternate route. No further information has been released on the identity of the individual who was killed in the crash or condition of others who were involved. The accident will be investigated by the Sacramento police to determine the cause. I would like to offer my condolences to the friends and family of the deceased.

Wrongful Death in a Car Accident

Driving is a dangerous activity and can lead to a South Sacramento fatality. Despite all the warnings, people still drink and drive or are reckless behind the wheel. In 2016 alone, over 40,000 people died in car accidents, and more than 10,000 were killed in a drunk driving accident. Overall, driver error is the main reason people die on the road, however, defective vehicles as well as reckless driving account for many deaths. When a loved one is killed by a negligent driver, their family is often thrown into emotional and financial turmoil. While no amount of money can make up for a loved one’s loss, a wrongful death claim can reduce the worry over paying for funeral expenses, hospital bills associated with an accident and necessities.

What Is a Wrongful Death Lawsuit After a South Sacramento Fatality?

A wrongful death lawsuit is a claim against a negligent person or entity that has caused the demise of another. Wrongful death claims are usually brought by the immediate family of the deceased. Such survivors are said to suffer financial damages due to the death of the decedent. The survivors are:

  • Immediate family members: This includes the spouse and children of the decedent.
  • Others: Stepchildren, parents or others who received at least half of their support from the decedent are eligible to be included in a wrongful death lawsuit.
  • A putative spouse or domestic partner of the decedent can file.

Elements of a Wrongful Death Lawsuit

Certain factors must be proven to file a wrongful death claim. They are:

  • The death of the family member must have been caused by another person who acted negligently or intentionally.
  • The deceased has survivors who depend on them financially.
  • Economic damages exist due to the person’s death.

Consulting With a Wrongful Death Lawyer

A wrongful death in a family, especially if that person provided the primary source of income, can cause serious financial harm. A seasoned wrongful death lawyer may offer sound advice and be able to help the family recover financial compensation. This is done by examining all the evidence in the case and using expert witnesses along with accident reconstruction and other techniques. Nothing will bring back a loved one, but knowing that the future will be more secure financially is one way to help ease the stress of your loss.
