What Types of Losses Are Recoverable in a Bodily Injury Claim?

When an individual is injured in a car wreck through no fault of their own, they may be eligible to seek reimbursement for relevant losses in a bodily injury claim. The purpose of financial compensation from a personal injury case is to make the injured party whole again and place them in the original position they were in before the incident. Claimants are generally entitled to reimbursement of current and future medical bills, wage loss and benefits, scarring and disfigurement, pain and suffering, and all other relevant damages.

Concerns may arise in multi-vehicle accident cases, particularly if there are several injured parties. The at-fault party’s insurance policy limits are usually allocated among all claimants. This may be concerning if the negligent motorist has limited coverage limits or no auto insurance. It is recommended that drivers in California carry uninsured and underinsured motorist coverage limits that are higher than the state-required limits of $15,000/$30,000. Our law firm generally recommends having $100,000/$300,000. You can rest assured that those limits will be available if involved in a serious crash.

Eligible claimants generally have no later than two years from the date of the car wreck to file the case in court if they are unable to reach a mutual agreement with the opposing party and insurance company. Exceptions may apply based on the case and the specific circumstances and facts involved. It is essential to involve an attorney in an accident case involving serious injuries. Insurance companies are likely to dispute liability, argue over the severity of reported injuries, and resort to defense tactics to get out of claim payouts. When you have a skilled attorney on your side, your rights will be protected.

Is It Worth Working With an Attorney on a Personal Injury Case?

Every personal injury case is unique because of the circumstances and facts surrounding the incident and the claimed injuries and losses. An attorney will prepare a formal demand letter to the insurer to seek reimbursement of economic and non-economic damages. While most cases are resolved through insurance settlement negotiations, others may not result in a mutual agreement. The right lawyer should be fully prepared to take the case to court if a settlement agreement cannot be reached with the insurance carrier and defense counsel.

An experienced attorney will seek maximum financial compensation for all past and future losses, including medical expenses, loss of earnings and benefits, disfigurement and scarring, pain and suffering, and all other relevant losses. In egregious cases, a lawyer will seek punitive damages from the opposing party. In the context of a multi-vehicle accident, an attorney will seek punitive damages from a negligent motorist if they were excessively speeding leading up to the car wreck or driving while impaired at the time of the incident.
