Driver Arrested in Wrong-Way Crash and Charged With DUI

The Nissan driver who caused the collision, age 27, was arrested for suspected drunk driving. Lanes were closed down for around an hour while the CHP traffic collision unit carried out an investigation into the incident. The lanes reopened around 4:00 a.m.

Personal Injury Claims

A wrong-way crash involving a head-on can cause severe trauma because the speeds of both vehicles are combined upon impact. Traumatic brain injuries, spinal cord damage and multiple bone fractures aren’t unusual in these types of accidents.

The following compensation may be available to you if you are injured due to the negligence of another driver with the assistance of an accident attorney:

  • Medical costs: At-fault drivers may be responsible for recovering medical expenses incurred by those who are injured in accidents. Hospitalization, physician fees, surgical procedures, and rehabilitative care can all result in high medical costs. In addition to compensation, ongoing treatment can also be taken into account.
  • Wages: A wrong-way crash can leave someone out of work for a significant period of time while they recover. They can, however, recover their wages as well as any benefits they usually would have received at their job. The difference is recoverable if the person cannot return to their previous position due to trauma and must accept a lower-paying position. In addition, a permanent disability may allow the injured person to recover their wages and benefits until the age when they would have reached retirement.
  • Pain and suffering: Physical pain and suffering compensation recovery is affected by the severity of the trauma and the extent of their medical care. Additional compensation may be available for emotional trauma, including depression, anxiety, and other conditions.

Recovery of Punitive Damages

Juries award punitive damages in rare instances. This type of award is meant to be a punishment for the negligent driver because their actions were especially egregious, such as drunk driving or they were intentional. The award of punitive damages is in addition to other compensation, not instead of, and in some cases, represents a high award. Your injury lawyer can review your case and tell you whether or not you would be able to request punitive damages.
