Causes of a Pedestrian Injury Accident

Pedestrian injury accidents can be caused by a variety of factors, including driver negligence and unsafe walking conditions, such as those below. An injury lawyer can determine the cause of an accident and who was at fault, so the injured pedestrian can potentially place a claim to recover compensation.

Driver Negligence in an Accident

The most common form of driver negligence that can lead to a major injury accident involving pedestrians is failing to yield the right-of-way. This can encompass a variety of violations, such as running a stop sign or red light or failing to look both ways before driving through an intersection. Other forms of negligence include distracted driving, speeding, and not using caution when turning or backing up.

In some cases, the driver may be impaired by alcohol or drugs, which can significantly increase their risk of causing an accident. Finally, drivers who are unfamiliar with the area they are driving in could cause a major injury pedestrian accident if they fail to take note of local regulations and high-risk areas.

Driver Caution Can Lower the Risk of a Major Injury Accident

No matter the cause, instances of driver negligence can lead to severe injuries and even death for pedestrians. It is important that drivers remain alert and follow all traffic laws to ensure they are not putting themselves or others in danger. By exercising caution while driving, we can make our roads a safer place for everyone.

Unsafe Walking Conditions

Poorly maintained sidewalks, inadequate lighting at night time, debris on the roadways, potholes and other hazards can create unsafe walking conditions that cause a pedestrian major injury accident. In some cases, these issues may have been caused by a municipality or other organization that failed to properly maintain the area. The government entity may be liable for injuries, but because the deadline to file a claim is only six months, enlisting the help of an accident lawyer might be prudent. The accident attorney cannot only handle your case but can negotiate with the government entity to help you obtain the compensation that you deserve.

Recovering Compensation With the Help You Need

The evidence that can support a pedestrian’s claim can be gathered by a personal injury lawyer investigating the accident. They can calculate the amount of pain and suffering that should be compensated to the injured party in addition to the medical bills and lost wages. Recovering damages in a compensation claim can alleviate financial stress and allow you to concentrate on getting well while you recover from your injury.
