Union Pacific Train Crash Kills Pedestrian Near Florin Road

A pedestrian died in the Florin area of Sacramento on June 9 after being involved in a Union Pacific train crash. The collision happened at the intersection of Florin Road and McComber Street around 8:30 a.m., according to a spokesperson for the Union Pacific Railroad. No additional information was released. Authorities are conducting an investigation to determine how the fatality accident occurred. The name of the deceased pedestrian pends notification of the family by the Sacramento County Coroner’s Office.

Liability for Pedestrian Deaths in a Union Pacific Train Crash

When railroad companies don’t protect people on foot from foreseeable harm, they may be held liable for the death of a pedestrian. Among the safety measures the railroad may implement are warning signs and fences along tracks and other areas where people might be exposed to its equipment. When those safety measures are not maintained properly, they could cause liability in the event of an accident.

Compensation for Pedestrian Fatalities Following Train Collisions

When a railroad company is found negligent in causing a pedestrian’s death, the family can file a wrongful death lawsuit for compensation for lost wages, funeral expenses, and pain and suffering. Immediate family members, including the surviving spouse and children, may file. If the deceased had no spouse and children, other family members may file, such as the parents or siblings.

In a Train Collision, Liability Depends on Negligence Types

It is also possible for railroad companies to be held responsible for injuries caused by negligence by an employee or owner of the tracks in a Union Pacific train crash. Railroad workers may also be held responsible if they failed to maintain safety measures or did not warn of impending dangers that ultimately led to an accident.

Recovering Damages After a Family Member’s Death

When a pedestrian is involved in an incident involving a Union Pacific train crash, it is crucial that the family seek the advice of professional legal counsel to determine their rights and find out whether they can recover compensation. Money cannot replace a loved one’s life and ease your grief when he or she died as a result of negligence. Often, by holding those responsible accountable for future incidents of this nature, we can prevent them from happening again.

Legal advice should be sought as soon as possible following a pedestrian death to ensure that your rights and interests are protected. Your loved one who was wrongfully killed will have the best chance of receiving justice if you act in this way.
