What Qualifies as Wrongful Death?

If the negligence or carelessness of an individual or entity causes the sudden death of another party, the situation may qualify as wrongful death under California law. In the event of a fatal pedestrian accident caused by a negligent motorist or entity, the surviving family members of the deceased may file a claim for damages against the other side to seek reimbursement for intangible and financial losses. These cases generally follow a deadline of two years, according to CCP 335.1. This means that a family has a maximum of two years to file the case in civil court if they do not reach a settlement with the other side.

Some examples of pedestrian accidents that may qualify as wrongful death include a motorist striking a pedestrian crossing with a green light and legally in the marked crosswalk, a driver running a traffic light or posted stop sign, a motorist operating a vehicle while under the influence of alcohol or drugs, and other careless driving behaviors. In short, an individual or entity may be held liable for damages when their negligence or carelessness leads to an accident that claims the life of a family member. Survivors facing such a situation should not have to deal with the stress of difficult insurers and litigation.

The untimely death of an individual may affect the people who love and care about them, including family and friends. It is essential to note that California law is specific to who has grounds and priority to file a claim for damages. According to CCP 377.60, the decedent’s surviving spouse, domestic partner, or children can file a case and have priority to do so. Specific circumstances and relationships with the decedent will define who can seek damages if there are no surviving children, domestic partner, or spouse.
