Patterson Man Killed in Single Vehicle Accident

Patterson Man Killed in Single Vehicle Accident

I’m Ed Smith, a Modesto personal injury lawyer. A single-vehicle accident in northeast Patterson claimed the life of a man on June 3, 2018. The incident occurred along Las Palmas Avenue in the vicinity of Elm Avenue shortly before 7:00 in the morning. A man was driving his 2012 Toyota eastbound along Las Palmas Avenue when he reportedly lost control of his vehicle and drifted off the road. The Toyota struck two palm trees in the area and, unfortunately, caused the driver to suffer fatal injuries at the scene. Officials have identified the victim as 24-year-old Jonathan Ausseintine of Patterson.

I would like to send my condolences to those grieving the loss of their loved one during this heart-wrenching time.

Single Vehicle Accidents

While most common traffic accidents involve two or more cars, there are instances when a crash happens with only one vehicle. For example, a driver attempts to swerve their vehicle in order to avoid an object in the roadway, such as an animal and ends up crashing into a building or fixed object. In these types of accidents, the driver will be found at fault most of the time; however, the motorist may be able to prove that the accident was a result of someone else’s negligence.

Road Defects

Poor road design or maintenance has the potential to cause an accident. Road defects such as potholes, malfunctioning traffic signals or inadequate signage can cause serious injuries or even fatality. In these instances, a claim must be brought against a government entity within the statute of limitations, which is six months or 180 days from the date of injury or death. A claim filed after this deadline may be deemed invalid, leaving the victim on the hook for their losses.

Auto Products Liability

Sometimes, single vehicle accidents are the result of manufacturing defects. These may include faulty accelerator pedals, brakes, air bags or inadequate protection provided by the vehicle roof in the event of a rollover accident. Since California is a state that recognizes the best interest of consumers, a manufacturer can be held liable for resulting damages in an auto product liability claim.

Phantom Vehicles

There are times when another motorist engages in a negligent act and forces you to take immediate action, further leading to a single-vehicle accident. For instance, an unidentified driver fails to clear the intersection and enters the roadway in your direct path, causing you to swerve out of your lane and strike a fixed object without ever making physical contact with your vehicle. These types of crashes are often referred to as phantom vehicle accidents.
