Older Pedestrian Injured in a Carmichael Motor Vehicle Accident
An older pedestrian was struck by a motor vehicle on September 28 in Carmichael at around 11:45 in the morning. The accident happened along Cypress Avenue just west of Manzanita Avenue, according to a report issued by the California Highway Patrol (CHP). The pedestrian who was struck appeared to have suffered a head injury, and an ambulance was summoned to the scene. The CHP will be conducting an investigation to determine how the accident occurred and to assign fault.
Older pedestrians, the young and disabled are among our most vulnerable citizens, especially when crossing a street. Because it can take longer for an elderly person or someone with a cane or in a wheelchair to cross a street, motorists are not always aware that someone is in the crosswalk. In addition, a child carries a low profile and may not be visible to motorists in larger vehicles. These are all reasons a motorist should obey traffic laws and exercise extra caution when driving. Some of the common ways negligence by a motorist occur include:
- Distracted driving is one of the main causes of all varieties of accidents. Although it is illegal in California to use hand-held phones while driving, many people still do it to text or talk. Other forms of distracted driving include talking to passengers, changing the radio station or eating and drinking.
- Drugged driving is becoming more common with the legalization of marijuana in the state. Illicit drugs and certain over-the-counter or prescription medicines can also affect a motorist’s ability to handle a vehicle safely. This negligence may cause serious injuries to an older pedestrian.
- Drunk driving kills more than 10,000 people every year and remains a hazard to other motorists. Because drunk drivers exhibit poorer reflexes, impaired judgment and even problems with vision, they are a danger to an older pedestrian and others.
- Reckless drivers exhibit a disregard for traffic laws. This can be shown by a motorist who tailgates, runs through a red light or traffic sign and cuts in and out of traffic. An older pedestrian is certainly at risk when a reckless driver is on the road.
How an Experienced Lawyer Helps
Following an accident, you may have worries about how you will pay your medical bills and other expenses. If negligence was the cause, you may benefit from the advice of an experienced lawyer, and calling right away is advisable. This helps keep evidence from being altered or covered up. We immediately send our investigation team to the accident site to interview witnesses, check the police report for accuracy and look for nearby cameras that might have caught the accident on video. They then use other techniques such as looking to see whether lack of road maintenance contributed to the crash and evidence of whether the driver didn’t try to stop in time to avoid a collision. When all the evidence has been compiled, it is given to our lawyers so they can build a strong case for compensation either with the insurance company or in court.
