North Highlands Personal Injury Cases

There are different types of personal injury cases. While car accidents are the most common, it does not stop there. Personal injury or tort law is where individuals injured by another’s negligence can obtain compensation for their financial loss. Not all injuries are due to negligence. In some cases, an intentional act is the cause of the person’s injury. In others, no one caused the accident, or both parties were at fault. However, most cases involve the liability of another person or entity involved in a crash. Let’s look at the top types of accidents that lead to personal injury.

Car Accidents

Motor vehicle accidents are among the most common causes of personal injury cases. With the number of vehicles on the road, car accidents happen frequently. The National Safety Council reported about 4.6 million injuries in car accidents in 2016 nationwide and approximately 40,000 deaths. Usually, one motorist drives recklessly or operates a car or truck while fatigued, impaired, or distracted. However, some accidents are due to a state agency’s lack of road maintenance, faulty traffic signals, or hidden signage. Injuries from car accidents can range from minor to severe. There are costs associated with a car accident, such as medical expenses, property damage, or lost wages. Such damages may be recovered. While you may be able to go it alone, having the insight of an injury lawyer can help you obtain the compensation you deserve.

Bicycle Accidents

With abundant good weather in California, bicycle accidents are common in North Highlands as elsewhere in the state. When a cyclist is hit by a motor vehicle, catastrophic injuries can result. Some of the most common are head injuries, particularly when a helmet is not worn, fractured bones and facial lacerations, or dental loss. Motor vehicle drivers must watch out for cyclists and understand that bicycles share the road with them. Cyclists are likewise bound to obey the same rules that road motorists do, including not cycling if impaired by drugs or alcohol. If the accident is due to a driver’s or other entity’s negligence, the bicyclist has the right to recover the cost of damages due to the crash.

Motorcycle Accidents in North Highlands Personal Injury Cases

Motorcyclists are frequently involved in accidents that result from the negligence of motorists or state agencies responsible for road maintenance. Due to their lack of protection, a biker can suffer significant injuries and death. Some of the more common reasons for an accident involve:

  • Left turns occur when a motorist turns left across a lane with a motorcyclist without noticing the bike is there.
  • Rear-end accidents: This type of injury on a motorcycle can result in serious injury for the biker, such as being thrown from his or her bike.
  • Single motorcycle crash: Such accidents can happen when defects in the road cause a bike to slide or skid. If a lack of proper road maintenance, poor design, or improper signage is involved, the bicyclist may be able to obtain compensation for the financial cost of his or her injuries due to a motorcycle accident.

Pedestrian Accidents

Some of the most brutal personal injury cases involve pedestrian accidents. Pedestrians have little to no protection when hit by a motor vehicle. Injuries depend on the pedestrian’s age, the car’s height, and speed. Older individuals are more prone to severe injuries, particularly fractures of the pelvis and femur. All pedestrians risk serious injury when the speed of the motor vehicle exceeds 25 mph. At 40 mph, pedestrians are more likely to be killed in an accident. The type of injury varies according to the point of impact. Long periods of convalescence may be necessary, and some families face the untimely death of a loved one.

Wrongful Death

Personal injury cases involving wrongful death are some of the most heart-wrenching. A wrongful death can be due to various acts, such as abuse or a negligent accident of one form or another. The family faces the grief of losing the person and the financial cost of their death. Such costs can be centered on burial and funeral expenses, the person’s support, or the loss of future earnings potential the decedent had before death. An injury lawyer can help the family through this most difficult time by filing a wrongful death lawsuit.
