Accident on Pasquale Road Occurs When Driver Loses Control

A major injury was reported in Nevada City on March 9 when a vehicle went off the road for unknown reasons. The accident occurred at Pasquale Road and Banner Quaker Road at around 9:35 p.m. California Highway Patrol (CHP) officers arrived, and they discovered a Toyota had exited the roadway and was on its roof.

One Person Suffers Major Injury in Run-Off-Road Collision

A tow truck was called to right the vehicle and remove it. One person inside the vehicle suffered a major injury and was taken to a hospital for further treatment. No other information was provided on whether there were other people inside the vehicle at the time it crashed. An investigation is underway by the CHP to determine the cause of the accident.

Run-Off-Road Accidents That Cause an Injury

Driver error usually leads to run-off-road accidents, which can include speeding, bad weather, distracted driving, etc. Some accidents that involve just one vehicle, however, can be caused by external factors. A person who suffers an injury in this situation may be able to claim fair compensation that can cover medical bills and time away from work, as well as obtain reimbursement for their pain and suffering.

Accidents Caused by Mechanical Failure

In run-off-road accidents, defects in the motor, tires, brakes, steering, or accelerator can be responsible. Among the possible causes are:

  • Run-off-road accidents that result in a major injury can occur when an engine suddenly stops working, and the driver has no control over what’s happening.
  • Having a tire blowout or tread separation can lead to the driver losing control, which can result in the vehicle veering off the road.
  • An accident can occur when a vehicle’s braking system fails, causing it to run off the road because it can’t be slowed down.
  • In the event of a power steering failure, the driver is unable to control the car because the wheel will lock.

With the help of an auto product liability lawyer, auto manufacturers, parts producers, vendors, and others can be sued if they cause an accident due to a mechanical defect. In order to ensure that engineers can examine a vehicle for defects, it is important to prevent its destruction following an accident. In California, when filing an auto products liability claim, negligence doesn’t have to be proved, only that the product was used as intended and no alterations were made to the part.

Negligence by the Government

A run-off-road accident causing a major injury can occur due to potholes, upheavals and fissures in the pavement, bad road design, and poorly placed signs, among other components. A government entity charged with the maintenance and design of a roadway can be liable if injuries occur. A lawyer can be useful when filing a claim against a government entity, as the statute of limitations is much shorter.

When filing a claim against the government, the injured person has only 45 days to file initially. If the government entity denies the claim, they have six months in which to file a personal injury lawsuit. In some cases, the government does not respond at all, which means the injured person has two years to file the lawsuit. A lawyer can assist with completing all paperwork correctly and submitting the claim before the statute of limitations runs out. The case will not be heard if the time limit has passed.
