Can an Injury or Wrongful Death Claim Be Placed for Juveniles?

Yes, the parents or guardians of the injured or deceased juvenile may place a claim against the negligent driver to recover compensation. It should be kept in mind that the statute of limitations for filing these claims is two years, after which the court will not hear the case. In addition, witnesses and evidence can disappear in this time period, so getting started with your claim as soon as possible is recommended.

What Can Be Recovered in a Personal Injury Claim?

All personal injury claims are different, so your injury lawyer can advise you what compensation you are likely to recover as well as calculate the damages. However, the following is recoverable in most cases:

  • All medical expenses caused by the accident can be recovered, including ambulance fees, hospitalization, surgeries, medications and rehabilitation. If the injury is ongoing, further medical costs can be calculated and included.
  • Wages lost because of the inability to work are recoverable. If the individual can no longer perform their job due to their injury and has to take work that pays less, that is calculated into the compensation. Permanent disability can result in wages being calculated until retirement age.
  • Compensation can be recovered for the physical and emotional pain and suffering.

What Is Recoverable in a Wrongful Death Claim?

Recoverable compensation in a wrongful death claim following a multiple fatality collision can include the following:

  • Wages until retirement age if the decedent was employed.
  • The cost of the funeral services and burial are recoverable.
  • The spouse and children may recover compensation for their personal losses.
  • Loss of household assistance is possible if the decedent regularly performed chores around the home.
