How Can a Wrongful Death Claim Help My Family?

When an individual has lost their life in an accident caused by the negligence of another driver or entity, the family of the decedent may have grounds for a wrongful death claim. This type of case is intended to compensate surviving family members for the loss of a loved one and the damages that have accompanied that tragedy. In a fatal motorcycle accident case, a claim may be filed against the insurance company representing the other driver that is responsible for the traffic collision. To prevail in a claim for financial compensation, survivors must establish various elements specific to the preponderance of the evidence as outlined by California law.

Every case is different, and therefore the types of economic and non-economic damages that may be recovered vary. However, some common types of compensatory damages sought in such cases may include medical expenses for treatment of the final injury the decedent suffered, costs of funeral and burial services, loss of financial support the deceased provided, lost inheritance, mental anguish, loss of companionship, and more. In some cases, punitive damages may be awarded as a way of punishing the at-fault party and deterring similar conduct from occurring in the future. Such damages are reserved in wrongful death cases where the other party’s conduct was particularly egregious.

There are also procedural rules in place in regard to who can file a wrongful death claim. Under the California Code of Civil Procedure Section 377.60, the spouse, domestic partner, and children have priority to bringing such a case forward, followed by other relatives who were financially dependent on the decedent. Given the strict filing criteria and deadlines involved in these cases, it is essential to retain legal counsel to determine what is required in your claim.
