What Damages Can Be Recovered in a Wrongful Death Claim for a Car vs. Motorcycle Crash?

Economic damages are losses that can be easily quantifiable through receipts, invoices, and other documents. They are intended to return survivors to their original position before the unexpected loss of their loved one. Given that economic damages measure a set value of financial losses, it is possible to prove the amount owed to surviving family members. However, expert witness testimony is often necessary to prove that these damages are reasonable and necessary. For instance, an accident attorney may call on an economist to provide their insight into the decedent’s expected future earning capacity based on their age, education, health, occupation, and other factors.

Non-economic damages are more challenging to quantify because they are intangible in nature. This means they are subjective and differ in value from case to case. The purpose of non-economic damages is to replace intangible losses that the wrongful death of a loved one has caused. Proving non-economic damages generally requires testimony from surviving family members to demonstrate how the loss has impacted their lives now and into the future. This may be in the form of family photos, home videos, and other evidence.

In addition to the mental anguish of a close relative’s death, survivors may also struggle with the sudden change in their household and dynamics. Surviving family members may require in-house support, especially if the decedent had minor children or close relatives who were dependent on them for assistance with daily needs. A family may also seek reimbursement for a deceased relative’s final arrangements, loss of companionship, and loss of future financial support. Survivors may also be entitled to the costs of end-of-life medical treatment through a survival action. For more details, reach out to an experienced Livermore wrongful death attorney.
