Modesto Major Pedestrian Accident

A Modesto major pedestrian accident occurred along Wade Avenue and Rouse Avenue on December 31, 2018. The incident happened at approximately 6:00 in the evening and involved a pickup truck and a pedestrian. A driver of a white pickup truck reportedly crashed into a man walking in the area and fled the scene following the collision. Medical personnel was called to the scene to transport the injured party to a local hospital for treatment of serious injuries. An update regarding the man’s condition has not yet been released by officials.

Common Reasons for Pedestrian Accidents

There are several common reasons for pedestrian accidents that lead to serious or even fatal injuries. These include:

  • Driver Inattentiveness: This is considered the most common cause of pedestrian accidents. This can result from texting or talking on a cell phone, adjusting the radio, eating or drinking while driving, and a wide array of other activities.
  • Failure to Stop or Yield: Motorists are obligated to yield the right of way to walkers at designated and undesignated intersections. Drivers exiting alleys, private roads, and out of driveways are also responsible for yielding to pedestrians on sidewalks.
  • Lack of Visibility: Approximately 26 percent of fatal pedestrian accidents occurred between 6:00 p.m. and 8:59 p.m., according to the National Highway Traffic Safety Administration. Walkers are more difficult to be seen at night by drivers, especially if they are wearing dark clothing.
  • Speeding: This is considered driving above the posted speed limit or too fast for current weather or road conditions. Pedestrians struck by speeding vehicles often suffer life-changing injuries or even pass away due to the force of impact.

Damages Due to a Pedestrian Accident

Aside from the pain, most individuals with pedestrian injuries will require extensive medical treatment and time away from work. This can cause significant financial concerns, especially if the injured party is the primary provider for his or her family. If this situation applies to you or a family member, you may benefit from the insight of an experienced Modesto personal injury attorney. An experienced injury lawyer will ensure that all lost wages and medical expenses will be recovered. While no amount of compensation can undo a pedestrian injury, being able to focus on recovering without financial worry can help. Liability in a Pedestrian Accident

When a pedestrian accident occurs, responsibility for the incident may fall on more than one party. Depending on the circumstances of the collision, those who may share fault include the entity responsible for maintaining the roadway, parking lot, or sidewalk where the accident happened and the motorist of the vehicle. In the case of a driver fleeing the scene of a pedestrian crash and remains unidentified, the injured pedestrian may seek recourse through his or her own automobile insurance policy. In most cases, damages from a hit and run accident may be covered under an injured pedestrian’s uninsured/underinsured motorist policy.
