Man Arrested After Fresno County DUI Crash

A Kingsburg man was arrested for DUI and causing a crash in Fresno County on the night of May 25, 2020. The car accident occurred in a rural area near Parlier, CA. A 41-year-old Kingsburg man was reportedly driving his Toyota Corolla at excessive speeds shortly before clipping a Chevrolet Malibu, propelling the vehicle into a tree, and pinning the driver inside. The Kingsburg man crashed his Toyota into an orchard shortly after the initial collision. The woman driving the Chevrolet was extricated from her vehicle by first responders. She was transported to a local hospital for treatment of leg injuries, according to the Fresno County Sheriff’s Office. The driver of the Toyota was not seriously injured and was arrested for driving under the influence (DUI). Officials said he was later released from jail on California’s emergency bail rule.

Recovering Compensation After a DUI Crash in Fresno County

When a person is injured after a car accident caused by a drunk driver, they may be able to file a personal injury claim for compensation against the at-fault party’s insurance company for their bodily injuries and property damage. In personal injury cases, an injured individual may be entitled to monetary damages for financial and intangible losses they have suffered as a result of the drunk driving accident and their injuries. However, the personal injury claims process for a DUI crash is not always straightforward. Some insurance carriers may require the injured party to prove negligence on the part of their insured, just like any other personal injury claim. This may be done by collecting evidence such as eyewitness testimony, traffic accident reports, breathalyzer test results, DUI convictions, video surveillance of the crash, and more. Keep in mind that insurance claims adjusters are not on your side, no matter how sympathetic they may present themselves when hearing about your accident and your situation. Insurers are businesses driven by profits and will protect their bottom line by paying as little as possible on a personal injury claim. To learn more about the personal injury claims process and the types of factors insurance companies look at to reduce the value of a case, watch the video below.

How Long Do You Have to File a Car Accident Injury Claim?

Under California law, a two-year statute of limitations applies to personal injury cases, meaning a person has two years from the date of their car accident to file a lawsuit. If a personal injury suit is not filed within the statutory deadline, the court may dismiss the case, and the injured party may lose the right to recover compensation. To protect the statute of limitations in your personal injury claim, it is best to contact an experienced Fresno car accident lawyer to discuss your specific situation.
