Injuries Reported in Los Banos Four Vehicle Crash

Officials reported injuries after a four-vehicle crash in the Los Banos area on the afternoon of June 5, 2020. The car accident occurred on Overland Road and Ingomar Grade shortly after 12:30 p.m. Two Ford F-150 pickup trucks, a Honda Accord, and a Hyundai Accent were involved in the crash. One vehicle reportedly caught fire in the collision, and at least one party was injured, according to the California Highway Patrol (CHP). Details such as the sequence of events leading up to the crash were not immediately available as an investigation is ongoing by the CHP.

Types of Compensation Available Through a Personal Injury Claim

Three types of damages may be claimed through a car accident injury case. The first is economic damages or special damages. They are intended to compensate for financial losses incurred as a result of a car crash and injuries sustained, such as past and future medical costs, missed days at work, and out of pocket expenses for medical devices or medications. Noneconomic damages or general damages refer to the intangible harms suffered as a result of an accident-related injury. This includes pain and suffering, loss of consortium, and lost enjoyment of life. Both damages are recoverable through a personal injury claim filed with the other driver’s insurance company. If the driver does not have enough insurance or none, a claim may be filed under an injured person’s uninsured/underinsured motorist provision of their policy. Punitive damages may also be recovered in cases of egregious acts like speeding or drunk driving. These are not paid by insurance companies. Instead, punitive damages are sought from the at-fault party as a way of punishing them for their wrongdoing and to deter similar behavior from them and others in the future.

What Factors Can Affect the Value of a Car Accident Injury Case?

When a person has been injured after a motor vehicle collision and intends on filing a personal injury claim, it is essential that they take the right steps to avoid jeopardizing the value of their case. At AutoAccident.com, our Los Banos personal injury lawyers can advise you accordingly. Some of the factors that can affect the value of a personal injury case for a car accident include:

  • Gaps in medical treatment, including missing appointments or rescheduling them too frequently
  • Providing a statement to the insurance adjuster regarding the personal injury aspect of a car accident case, which is not recommended as claims adjusters may misconstrue your words as a way of discrediting your claim and its validity
  • Settling a personal injury case too quickly without receiving the proper medical treatment needed
  • Failing to follow orders from medical providers

How Long Do You Have to File a Claim for a Four Vehicle Crash in Los Banos?

A personal injury claim for a car accident has a deadline for recovery. This is known as the statute of limitations, which is two years in California. This means you must file a lawsuit before the two-year statute of limitations expires if you do not settle your claim with the insurance company. If you fail to do so, your case is likely to be dismissed by the court, and you may run the risk of losing the right to recover monetary damages. A personal injury attorney in Los Banos can ensure all filing deadlines are met in your case to protect your rights and recover the compensation you need to move on with your life.
