Pedestrian Killed in Crosswalk on Coloma Road

A pedestrian fatality accident was reported following a hit-and-run in Rancho Cordova on September 8. The collision occurred around 5:00 a.m. near McGregor Drive and Coloma Road as a woman was struck crossing the street, according to the Rancho Cordova Police Department. She died as a result of the collision. The name of the deceased will not be released until the family has been notified by the Sacramento County Coroner’s Office. No information was released about the vehicle or driver in the incident.

Recovering Compensation After the Death of a Loved One

The loss of a loved one is a trying time in a family’s life and is much worse when the pedestrian fatality accident should never have happened. This type of loss not only leaves the family grieving but wondering why it happened and how. When a pedestrian dies in an accident, the family may be able to recover damages by filing a wrongful death claim against the at-fault party. Although it will not ease their pain, it can help them move forward because they obtain justice for their lost loved one.

How an Attorney Can Help Find a Hit-and-Run Driver After a Pedestrian Fatality Accident

If you are the family of a loved one killed in a hit-and-run pedestrian accident, you may be feeling shocked and unsure of what to do next. An experienced personal injury attorney can help you investigate the accident, locate the responsible driver and pursue compensation for your losses.

Your attorney will likely begin by investigating the accident to identify any possible witnesses or surveillance footage that could help identify the hit-and-run driver. This is a crucial step in the process. Once the driver is located, your attorney will work to negotiate a fair settlement with the driver’s insurance.

What Happens When the Driver Cannot Be Found

There are times when the fleeing driver cannot be found. This does not mean that the family must bear the financial burden that comes with the death of a loved one. Instead, California allows the family to use their uninsured/underinsured automobile policy. This covers the policyholder whether they are in a motor vehicle or walking down the street. If the decedent did not have this policy, a household member might use their policy instead. There is no increase in the premium.

What Can Be Recovered in a Pedestrian Fatality Wrongful Death Claim?

In a wrongful death claim in California, the survivors of the deceased may be able to recover damages for the following:

  • Funeral and burial expenses
  • The deceased’s lost earnings and benefits, including pension benefits
  • Loss of love, companionship, care, comfort, society, and moral support
  • Loss of consortium between spouses
  • Loss of inheritance
  • The cost of household tasks such as landscaping or tax filing the deceased would have performed
  • Children can claim the loss of nurturing the decedent would have provided
