What is Wrongful Death?

Experiencing the loss of a close relative in situations that seem preventable is a devastating event. In cases where a family member suffers fatal injuries in an incident due to someone else’s negligence or carelessness, a wrongful death case may offer compensation and a sense of justice for the family left behind to pick up the pieces. Bringing a strong case with clear and compelling evidence may result in a successful result through a settlement or verdict. This may offer financial compensation to surviving family members to support them in the absence of their close relatives.

Surviving family members bringing a wrongful death action forward seek compensation for the financial and emotional hardship they have endured due to the sudden loss of a loved one in an accident. Eligible survivors include those that meet the criteria set forth in CCP 377.60. This generally includes the immediate family of the deceased, such as children, registered domestic partner, or spouse. It is possible for other family members to be considered if the decedent is not survived by the relatives previously mentioned. This will depend on the facts and circumstances of the case.

There are strict filing criteria involved in cases of wrongful death. In the state of California, survivors have a two-year window from the date of a close relative’s demise in an accident to file a case in civil court. Some exceptions may apply to the two-year statute of limitations that generally applies in these matters. As such, starting the legal process at the earliest opportunity is advisable. Retaining legal counsel generally increases the overall success of a wrongful death case as an attorney works diligently to build a strong case while protecting the rights and interests of their client.
