Can a Wrongful Death Case Help Our Family?

Wrongful death is characterized as a loss of life resulting from the negligent actions of a person or entity. In California, the surviving family members of the decedent may have grounds to file a wrongful death claim against the other side for damages incurred. Those that have priority in filing such cases include the surviving spouse, domestic partner, and children. Other relatives may be eligible for filing so long as they meet the criterion set forth in the California Code of Civil Procedure Section 377.60. The purpose of these civil cases is for the direct benefit of survivors and for them to be made whole again in the form of compensation. Economic and non-economic damages may include medical bills associated with the final injury (generally recoverable through a survival action), lost future financial support, funeral service costs, loss of benefits, mental anguish, loss of care and companionship, and more.

Remember that there is not an unlimited amount of time allowed to file a claim. There is a two-year statute of limitations that generally applies to these cases, as outlined in the California Code of Civil Procedure Section 335.1. There may be special circumstances applicable to the case depending on the parties involved. For instance, if a public agency is named as a defendant, the filing deadline is shortened to 180 days. This is by the California Government Code Section 911.2. Failure to meet specific deadlines may result in the forfeiture of the family’s right to take legal action against the at-fault party.
