Fatal Rollover Wreck Reported in Madera County

Officials in Madera County reported a fatal rollover wreck on the early morning of Monday, February 7, 2022. The motor vehicle collision occurred around 4:00 a.m. near Sharon Street and Santa Fe Drive near Road 24 in the Chowchilla area.

Details on the Fatal Rollover Wreck Reported in Madera County

California Highway Patrol (CHP) officers responded to a report of a single-vehicle accident in the area. Upon the arrival of authorities, it was determined that two parties were ejected from the car involved in the rollover accident.

The passenger in the vehicle reportedly had complaints of pain, but it is unknown whether they were later hospitalized for their injuries. Sadly, the driver of the vehicle succumbed to their injuries at the scene. The cause of the incident is under investigation by CHP traffic officers, and additional information on the crash was not immediately available.

What are the Possible Causes of a Rollover Accident?

A fatal single-vehicle accident involving a car overturning several times is not always the result of driver error. Other contributing factors may include unsafe road conditions and defective vehicle parts and equipment. That is why it is essential to retain legal counsel with years of experience handling rollover collision cases. An accident attorney can work with their team of experts to determine whether contributing factors such as faulty car components, failure of the car in meeting roof crush resistance criteria set out by the Federal Motor Vehicle Safety Standard 216, lack of roadway maintenance, and unsafe road design may have led to a crash resulting in bodily injury or loss of a loved one.

Keep in mind that either of these situations requires the vehicle in question to be kept and preserved for a lawyer to examine with experts later. Conversely, the two-year statute of limitations that generally applies to personal injury and wrongful death claims may be shortened to 180 days in those cases involving government entity negligence. Refer to California Government Code Section 911.2 for more details.

What Types of Damages are Recoverable in a Wrongful Death Case?

A wrongful death claim allows the surviving family members of a decedent to seek financial compensation for their loss from the at-fault party or entity. Those who have priority to bringing such cases forward include the surviving spouse, domestic partner, or children of the deceased. This is by the California Code of Civil Procedure Section 377.60. Other relatives may be eligible for filing if such relationships with the decedent are non-existent. While each case is unique because of the facts and circumstances involved, some of the economic and non-economic damages survivors may recover may include but are not limited to:

  • Bills for end-of-life medical treatment for final injuries associated with the rollover collision may be recoverable through a survival action.
  • Costs of funeral services may be determined through receipts and recovered by the relative who paid for them.
  • Loss of future financial support that would provide survivors with the compensation they need to offset the amount of earnings the deceased individual would have made throughout their lifetime had the fatal car accident not occurred. Confirming and calculating this type of damage often requires the testimony of expert witnesses such as an economist to establish present-day and expected future value.
  • Lost protection, companionship, and care may be recovered by the survivors of the decedent. The value of this non-economic damage may vary as it is subjective in nature.
  • Mental anguish represents the intangible harm and emotional trauma that surviving family members have endured because of the wrongful death of a loved one.

Wrongful death laws in California may be challenging to navigate. That is why it is essential to retain legal counsel with years of experience handling cases such as these. Details on how to find the right lawyer for your wrongful death claim are available through this video.
