What Families Should Know About Fatal Accident Cases

There is no doubt that the unexpected loss of a close relative is a devastating and painful experience for surviving family members. While survivors need time to proceed with their loss and grieve in peace, the reality is that insurance companies will not be waiting. That is why it is crucial for families to act quickly by holding the other side liable and seeking maximum compensation. While no amount of money may make things right again, bringing a wrongful death claim against the at-fault party or entity may provide survivors with a sense of justice and closure.

In most situations, the only way that surviving family members can hold the other side liable for their loss is to seek economic and non-economic damages through an insurance claim or in civil court. This allows survivors to seek reimbursement for the financial and intangible losses that they have experienced because of the sudden loss of their close relative. Each case has its own unique losses and expenses, but examples may include medical expenses for final injuries, mental anguish, lost earnings, funeral costs, loss of care and companionship, and more.

California’s wrongful death laws usually allow the decedent’s immediate family to bring a wrongful death case so long that a lawsuit is filed in civil court before the deadline passes. To accomplish this, a family must have clear and compelling evidence to support the fatal accident claim and be able to document their economic and non-economic damages. Bear in mind that a two-year statute of limitations generally applies to most cases. While this may seem like ample time, the evidence must be collected and secured before it disappears over time. Fortunately, an experienced accident attorney can help with that.
