A preliminary release by authorities indicated that construction crews at a road closure were cutting concrete. Can You Seek Compensation for Damages from a Hit-and-Run Accident?

A driver may be held liable for injuries and damages in an accident caused by their negligence. This may include driving under the influence, speeding, running stop signs or traffic signals, not yielding the right-of-way to others, and other unsafe driving behaviors. If a party is injured in a car wreck through no fault of their own, they may seek reimbursement for damages from the negligent driver through a personal injury claim against the other side and their insurance carrier. Such claims may seek reimbursement for pain and suffering, wage loss, medical bills, and other crash-related losses.

In fatal accident cases, surviving family members may file a wrongful death claim against the other side to hold them liable for their loss and the resulting damages. These cases are intended to make survivors whole again. Reimbursement may include costs of medical care (recovered through a survival action), loss of financial support, mental anguish, loss of companionship, funeral service costs, loss of benefits, and more. If the incident was due to a hit-and-run, the family may file an uninsured motorist claim for reimbursement. UM coverage may apply even if the hit-and-run driver is not found.

California has a time frame where claimants must file a personal injury or wrongful death case in civil court before they lose the right to do so. This is known as the statute of limitations. In most cases, a two-year deadline generally applies. It is essential to retain legal counsel immediately after a crash to ensure that the statute is protected.
