What Families Should Know About Hit-and-Run Accidents and Wrongful Death Cases

The California Code of Civil Procedure Section 377.60 governs which relatives have priority in bringing a wrongful death claim. This includes the surviving spouse, domestic partner, and children. If these relationships do not exist, then other relatives may have grounds to bring the action, such as stepchildren, parents, and other family members who were financially dependent on the deceased. Economic damages and non-economic damages may be recovered in a wrongful death case in California. Economic damages are intended to cover financial losses while non-economic damages serve the purpose of compensating survivors for the intangible harm they have endured because of a loved one’s wrongful death. These losses may include mental anguish, loss of companionship, lost future financial support, funeral costs, and more.

Surviving family members may often wonder whether or not they have recourse for a fatal hit-and-run accident case. What many may not know is that uninsured motorist coverage may come into play for these situations up to the limits of the policyholder’s plan. Therefore, if the decedent has an auto insurance policy with uninsured and underinsured motorist protection, survivors may bring a UM claim under that plan. There are other situations where the deceased did not have a car insurance plan but lived in a household with a relative who did. Under these circumstances, a claim may be brought under that relative’s insurance policy if they carry UM and UIM coverage so long as they did not list the deceased as an excluded policy member.

Keep in mind that evidence must demonstrate that the driver involved in the hit-and-run accident made contact with the deceased family member, and that was the direct cause of their fatal injuries. Collecting and preserving evidence after a fatal hit-and-run bicycle accident may seem like a daunting task while coping with grief and dealing with unexpected expenses. That is why it is crucial to work with an experienced accident attorney who can get to work quickly on your behalf by working with a private investigator to track down the suspect driver and hold them liable for resulting damages.
