Time Limit for Auto Accident Cases in California

Under California law, a claimant has no later than two years from the date of a crash to file a case for personal injury or wrongful death against the at-fault party. Remember that an attorney needs time to receive the claim, gather evidence, consult expert witnesses, prepare a demand letter for the insurance carrier, and handle other tasks associated with the case within that period. That is why it is important to retain legal counsel immediately after a catastrophic car wreck. While it may be challenging to discuss a case after getting injured or losing a loved one, starting the legal process immediately is essential.
