Bringing a Wrongful Death Claim for a Fatal Head-On Collision

Experiencing the unexpected death of a family member is an extremely challenging and difficult situation to come to terms with. One moment, the family is living happily together, planning for the future, and offering mutual support, and the next moment, surviving family members are confronted with the reality of life without a loved one. This is particularly devastating when the loss occurs due to an accident caused by the negligence or carelessness of another party. By bringing a wrongful death case with the assistance of an attorney, survivors have the opportunity to seek justice and compensation for their loss.

Wrongful death claims are the result of many types of preventable accidents. Examples of some cases that attorneys commonly handle include motor vehicle accidents, including head-on collisions. There are specific criteria that must be met when filing these cases. This includes proving negligence, filing eligibility, statute of limitations, and other requirements. Most cases must be filed within two years from the date of the incident that claimed a loved one’s life, and legal counsel requires substantial time to prepare a strong case to present in insurance negotiations or in the courtroom if necessary.

The initial focus of surviving family members may not be on taking legal action after losing a loved one in an accident. However, ensuring that justice is obtained and telling their story is often dependent on it. An experienced wrongful death attorney can offer the compassionate support and guidance survivors need to rebuild their lives and secure their futures. At AutoAccident.com, we have the necessary knowledge, resources, and connections to conduct a thorough investigation into a fatal incident to properly establish the opposing party’s liability.

Time is of the Essence in Wrongful Death Cases

It is essential to investigate how a fatal incident occurred immediately. Evidence may be lost or covered up, and without evidence, it may be challenging to establish causation and damages in a civil case. Whether the fatality resulted from a motor vehicle collision or another situation caused by negligence, the success of the case depends on the assessment of relevant and admissible evidence. This is where an experienced attorney steps in. The right lawyer will handle the case, manage communications with the opposing party, and work toward a settlement agreement that addresses the clients’ full extent of losses.
