How an Attorney Can Help Surviving Family Members

When a loved one is lost in a car accident, the grief and pain are unimaginable. When the loss was the result of another party or entity’s negligence, other emotions such as frustration and anger may also emerge. In addition to emotional hardship, surviving family members may also experience the stress of settling financial affairs and attempting to plan for a future without their beloved member by their side.

During this challenging time, it is essential to seek the assistance of an experienced Jamestown car accident lawyer. An experienced attorney will work diligently to protect the rights and interests of survivors all while working to obtain a successful resolution in their case. While no amount of compensation will bring a loved one back, it may make all the difference in protecting a family’s future in the aftermath of a close relative’s death.

What Damages are Available for Wrongful Death?

When a family has lost a close relative in a traffic collision because of someone else’s negligence, the family may be entitled to compensation for economic damages and non-economic damages. These may include but are not limited to:

  • The costs of medical care for treatment of the decedent’s final injury
  • Expenses for funeral and burial services
  • Loss of a loved one’s assistance, protection, companionship, and guidance
  • Lost future financial support and benefits
  • Mental anguish from losing a loved one in a car accident

When a close relative’s death has occurred because of someone else’s conduct that is considered egregious, surviving family members may seek punitive damages from the at-fault party with the assistance of an experienced accident attorney. Punitive damages serve the sole purpose of punishing the wrongdoer for their actions. For additional information on wrongful death claims, watch the video below.

Is There a Time Limit on Wrongful Death Cases in California?

Under California law, wrongful death cases are subject to a strict time limit known as the statute of limitations. A lawsuit must be filed in civil court within two years from the date of the fatal incident, as outlined in the California Code of Civil Procedure Section 335.1. Failure to file suit within the statute of limitations applicable to the case may allow the court to dismiss the case and result in the loss of the family’s right to seek any financial compensation from the at-fault party.

As you may see, the filing procedures involved in wrongful death cases arising from motor vehicle crashes may be challenging to navigate. That is why it is essential to retain legal counsel immediately following the loss of a loved one in a traffic collision. An experienced attorney will work to ensure that all filing criteria and deadlines are met in the case all while allowing survivors with the time they need to recover from their loss.
