A preliminary report revealed that a two-vehicle collision occurred on eastbound SR-92. The initial crash involved a silver Infiniti G35 and a black Hyundai Elantra, CHP traffic officers said. The Infiniti driver allegedly exited their vehicle after the initial crash when they were reportedly struck by a black Cadillac Escalade.

Anyone with information on the collision is encouraged to contact the CHP Redwood City office at (650) 779-2700 and speak with Officer Yang.

What is Wrongful Death?

A fatal traffic accident in California may occur from a wide array of causes. Among the most common include distracted driving, driving under the influence of alcohol or drugs, and speeding. When a motor vehicle collision deprives a family of a loved one, survivors may have grounds for a wrongful death claim. These cases seek compensation as a way of making an affected family whole again.

Eligible surviving family members may be entitled to reimbursement for economic and non-economic damages. These may include expenses for funeral and burial services, loss of future earnings, loss of companionship, mental anguish, and other losses. Aside from these, punitive damages may be sought from a driver if DUI was a contributing factor to the incident.

How Long Do You Have to File a Wrongful Death Case in California?

The resolution of most wrongful death claims is through an insurance settlement. However, if a mutual settlement agreement cannot be reached with the insurer, a wrongful death lawyer will not hesitate to file the case in civil court and take it to trial to fight for what is right for survivors. Remember that a two-year statute of limitations generally applies to fatal accident cases per CCP 335.1. If surviving family members fail to protect the statute, they may lose the right to seek damages from the at-fault party.

Despite the two-year time limit, it is in a family’s best interest to discuss their case in detail with an experienced Hayward wrongful death lawyer. That is because an attorney will need evidence to prove a fatal accident case for financial recovery. The longer the time between the date of loss and retaining legal counsel, the more challenging it may be for an accident attorney to gather and preserve evidence before it is destroyed or lost over time.
