Fatal Crash on Holly Street in Oakland

On September 24, 2023, the Oakland Police Department reported a fatal two-vehicle crash at Holly Street and 73rd Avenue. The traffic collision occurred shortly before 10:00 a.m. and was reported by officials as a hit-and-run accident.

Details on the Fatal Crash on Holly Street in Oakland

A preliminary report by Oakland PD indicated that one vehicle was headed southbound on 73rd Avenue. The driver of that car was making a left-hand turn onto Holly Street when it was allegedly broadsided by a second vehicle traveling at high speeds northbound along 73rd Avenue. The impact of the collision reportedly propelled the first vehicle, causing it to overturn into a parked vehicle in the area.

The motorist behind the wheel of the second vehicle allegedly exited the car and fled the scene on foot, officials reported. It was later discovered that the second car, a Lexus G-350, was stolen, authorities said. The suspect party, a 25-year-old, was later arrested by Oakland PD close to the crash site and faces charges in connection with the hit-and-run accident.

The passenger in the rear of the first vehicle suffered injuries and was transported to the hospital for immediate treatment. Officials said the driver and front-seat passenger of the first car, Derrick Shaw, age 64, and Vera Hampton, age 67, were declared deceased at the crash site. The incident is under investigation, and no further details were immediately available.

What is Wrongful Death?

If the negligence or carelessness of another party or entity causes the sudden loss of life, the situation may qualify as wrongful death under California law. In the event of a loved one’s wrongful death, the surviving family members may file a claim for damages against the party responsible for the fatal incident. Eligible survivors are outlined in CCP 377.60, including the spouse, domestic partner, or children. These relatives have priority for filing. Other family members may be eligible to file a case if these close relatives do not exist. For more details, contact an experienced attorney near you.

How Long Does It Take to Resolve a Wrongful Death Case?

Determining the exact amount of time that it will take to resolve a wrongful death car accident case is not always possible. This is due to the unique facts and circumstances involved in each case. Each claim will involve a different incident, injured party or decedent, and insurers. Moreover, other factors that may play a role in the case resolution timeline may include the amount of time it takes for the other side to accept liability, how long it takes to conduct an in-depth investigation into the accident, the time it takes for the full range of economic and non-economic damages to become known, etc.

Another factor that may contribute to how long a wrongful death claim takes to resolve is the involvement of a hit-and-run driver. This is particularly true if the other party is unidentifiable. For such reasons, it is helpful to work with an experienced lawyer. An attorney can review the incident in detail and determine if other avenues of financial recovery may apply if efforts in tracking down the hit-and-run driver are unsuccessful by law enforcement and a private investigator the lawyer hires in the case.
