Details on the Fatal Collision on I-580 and Eden Canyon Road

A release by responding CHP traffic officers revealed that a 2021 Ford E-Transit van was parked along the right shoulder of westbound Interstate 580. A 2021 Chevrolet Trailblazer allegedly veered off the roadway and onto the shoulder, where it struck the van and its driver standing outside the vehicle at the time of the incident. Sadly, the van driver, 22-year-old Hayward resident Mario Nunez, suffered fatal injuries. Additional details were not immediately available.

What is a Wrongful Death Claim?

Losing a close relative is one of life’s most painful and challenging experiences. If a family member died in an accident they did not cause, it may be more challenging to come to terms with the loss of life. Survivors can hold the individual or entity responsible for the fatal incident liable for losses through a wrongful death action. These cases allow the deceased’s immediate family to seek financial compensation for losses resulting from the wrongful death of a loved one. These may include economic and non-economic damages.

Losses that surviving family members may recover from a wrongful death claim include mental anguish, loss of income and benefits that the deceased would have provided for the family, funeral, and burial costs, loss of services that the decedent would have provided to the family household, end-of-life medical costs (through a survival action), and more. Only specific parties can claim compensation if a close relative suffers fatal injuries in an accident. Under CCP 377.60, these include the children, spouse, or domestic partner. Some exceptions may apply if these relatives are non-existent.

Concerns may arise if the at-fault party has insufficient insurance or no liability coverage. In either case, surviving family members may have recourse through the decedent’s auto insurance policy. If the deceased carried uninsured and underinsured motorist coverage at the time of the incident, a claim may be brought through the policy if it has been determined that the other side has no insurance or has minimal coverage limits. An experienced California wrongful death lawyer can investigate an accident, hold liable parties accountable, and seek full compensation.

Importance of Having an Attorney After an Auto Accident

After a catastrophic crash, a skilled California personal injury attorney can help a claimant prove that other parties in the incident are responsible for the resulting losses. These parties may include auto manufacturers for faulty vehicle parts or equipment, government entities for unsafe road conditions caused by poor design or insufficient maintenance, other drivers contributing to the collision due to their carelessness or negligence, the employer of the driver who was working at the time of the crash, and more.
