What is a Wrongful Death Case and How Can it Help Our Family?

A wrongful death claim can help surviving family members ease their financial hardship while they are grieving and recovering from their loss. Since the legal process may often be stressful and challenging, survivors should consider retaining legal counsel immediately. An attorney can help a family by handling their case from start to finish. This generally includes an independent investigation of the crash to determine fault, collecting evidence before it is destroyed or lost over time, working with expert witnesses to establish negligence and damages incurred, and more.

Economic damages in a wrongful death claim are intended to provide reimbursement for measurable losses and return survivors to the financial position they held before they lost their close relative. Economic damages generally include lost wages, benefits, and other financial contributions the decedent provided to the family. It may also include the costs of a funeral and burial. Non-economic damages reflect intangible losses that generally include mental anguish and loss of protection, care, and companionship. While rare, punitive damages may be available in situations where the other side’s actions were egregious, like excessive speeding or drunk driving.

In California, wrongful death actions are submitted by a decedent’s spouse, domestic partner, or children. These individuals have priority for these matters, as outlined in CCP 377.60. Depending on the facts and circumstances of the case, other relatives may be eligible to bring a claim forward.
